Terms of Service

1. Purpose

These Terms of Service (hereinafter "ToS") define the terms and conditions for using the FinQuest mobile application and website (hereinafter "the Application"), published by Warpen Kft. (hereinafter "the Publisher").

Using the Application implies unconditional acceptance of these ToS. If you do not accept these conditions, you must not use the Application.

2. Definitions

User: any individual accessing the Application and creating an account.
Content: all lessons, quizzes, learning paths, texts, images, and elements made available by the Publisher.
Account: the User's personal space, created upon registration.
Coins ("Jetons" in the French interface): the Application's single virtual currency. They are earned for free through use or bought through in-app purchases.
Energy: the resource consumed to take lessons. It refills automatically over time, can be refilled with Coins or by watching a rewarded ad, and is unlimited for Premium Users.
Premium: paid subscription providing access to all Application features.

3. Access to the Application

The Application is available for free on the App Store (Apple) and Google Play Store. Some features are reserved for Users with a Premium subscription.

The Publisher reserves the right to modify, suspend, or discontinue all or part of the Application at any time, for maintenance, updates, or any other reason, without entitling the User to any compensation.

4. Registration and User Account

4.1. Registration Requirements

To create an Account, the User must be at least 18 years old. Registration can be completed via email, Google (OAuth), or Apple Sign-In.

The User agrees to provide accurate information and keep it up to date. Anonymous mode is available but limits access to certain features.

4.2. Account Security

The User is solely responsible for the confidentiality of their login credentials and all activity on their Account. In case of unauthorized use, the User must immediately notify the Publisher at [email protected].

5. Service Description

5.1. Financial Education Service

FinQuest is a financial education application offering interactive, gamified lessons organized in progressive learning paths. The Application allows you to:

Take short lessons (approximately 3 minutes) on financial topics
Answer interactive quizzes
Answer a daily revision quiz
Track your progress and earn rewards (experience points, daily streaks, Coins)

5.2. Free and Premium Features

The free tier provides access to a limited number of lessons and features. The Premium subscription unlocks all learning paths, advanced features, and removes certain limitations. Pricing is detailed in the Terms of Sale.

5.3. Rewarded Advertising

The Application offers rewarded ads: the User may choose to watch an ad to obtain extra energy or tokens. Watching is always voluntary, no ad is forced, and no ad is loaded until the User asks for one. Consent arrangements are described in the Privacy Policy.

5.4. Gamification

The Application includes gamification elements (experience points, daily streaks, energy, Coins). These elements are purely virtual and have no monetary value. They cannot be exchanged, sold, or transferred outside the Application.

6. Coins and Energy

The Application uses two types of virtual currency:

Coins: earned for free through use of the Application (lessons, streaks, daily quiz, daily gift, referrals, rewarded ads) or bought through in-app purchases. They refill energy and unlock certain features.
Energy: consumed to take lessons, refilled automatically over time, with Coins, or by watching a rewarded ad. It is unlimited for Premium Users. Energy cannot be bought directly with real money.

Coins constitute a limited, personal, non-transferable, and revocable license to use a digital element within the Application. They are not electronic money within the meaning of Directive 2009/110/EC and have no value outside the Application.

The Content provided by FinQuest is exclusively educational and informational. It does not constitute:

investment advice within the meaning of Directive 2014/65/EU (MiFID II);
personalized investment recommendations;
an incentive to buy or sell financial instruments;
financial, tax, or legal advisory services.

You are solely responsible for your financial decisions; the Publisher is not liable for losses resulting from decisions made based on the content. 8. User Obligations

The User agrees to:

use the Application in accordance with its intended purpose and these ToS;
not use the Application for illegal, fraudulent purposes or purposes that infringe on third-party rights;
not attempt to bypass security measures or gain unauthorized access to the Publisher's systems;
not reproduce, copy, sell, or exploit all or part of the Application or its Content without authorization;
not use bots, scripts, or automated tools to interact with the Application;
not create multiple accounts to circumvent the Application's rules.

9. Intellectual Property

All elements of the Application (texts, lessons, quizzes, images, logos, design, source code, databases, trademarks) are the exclusive property of the Publisher or are used under license and are protected by intellectual property law.

The User is granted a limited, non-exclusive, non-transferable, and revocable license to use the Application for strictly personal and non-commercial purposes.

10. Limitation of Liability

The Publisher makes every effort to ensure the availability and proper functioning of the Application. However, the Application is provided "as is". The Publisher does not guarantee:

that the Application will operate without interruption or errors;
that results obtained will be accurate or reliable;
that the Application will be compatible with all devices.

Under no circumstances shall the Publisher be liable for indirect damages (data loss, revenue loss, lost profits) resulting from the use or inability to use the Application.

11. Suspension and Termination

11.1. By the Publisher

The Publisher reserves the right to suspend or terminate a User's Account in case of violation of these ToS, fraudulent behavior, or infringement of third-party rights, without notice or compensation.

11.2. By the User

The User may delete their Account at any time from the Application settings or by contacting [email protected]. Deletion results in the permanent loss of all data, progress and Coins associated with the Account.

12. Modifications to the ToS

The Publisher reserves the right to modify these ToS at any time. Users will be notified of substantial changes by notification in the Application or by email. Continued use of the Application after notification constitutes acceptance of the new ToS.

Dispute Resolution

In accordance with Directive 2013/11/EU on consumer ADR, if a dispute is not resolved by customer service, you may refer it free of charge to the territorially competent conciliation board. For the Publisher's registered office:

Consumers residing in another EU country may contact the competent ADR body in their country of residence.

Governing Law and Jurisdiction

These ToS are governed by Hungarian law, without prejudice to the mandatory consumer-protection provisions applicable in your country of habitual residence. Failing an amicable settlement, disputes fall under the competent courts, subject to mandatory consumer jurisdiction rules.
